The Data Act strengthens switching between covered data processing services, including cloud and SaaS. We help you understand which data you can transfer and how to request it.

What does it provide in practice?

For services covered by Chapter VI, the provider must facilitate switching and make exportable data available. SaaS and PaaS require at least a commonly used, machine-readable format: not any format on demand.

From 12 January 2027, switching charges, including data egress charges, cannot be imposed. Before that date, reduced charges cannot exceed costs directly related to switching. This does not make every professional service, subscription or contractual obligation free.

Applicability, transferable data and assets, third-party rights, personal data protection and exceptions for bespoke services must be assessed. The Data Act does not grant absolute ownership of every data item.
